PERLINDUNGAN PRODUK GARAM TRADISIONAL DESA PESINGGAHAN BERPOTENSI HAK KEKAYAAN INTELEKTUAL MELALUI INDIKASI GEOGRAFIS

Abstract

Tujuan tulisan ilmiah ini yakni untuk mengkaji perlindungan hukum bagi produk garam tradisional desa pesinggahan terkait kepemilikan kekayaan intelektual. Metode yang digunakan berupa penelitian hukum empiris melalui pendekatan peraturan perundang-undangan serta pendekatan fakta. Dari penelitian ini hasilnya mengemukakan bahwasannya perlindungan hukum bagi produk garam tradisional desa pesinggahan merupakan HKI khususnya warisan budaya desa pesinggahan, dan secara nasional di Indonesia mengacu pada UU No. 28 Tahun 2014 mengenai Hak Cipta dan UU No. 20 Tahun 2016 tentant merk dan indikasi geografis. Garam desa pesinggahan bisa dijadikan produk indikasi geografis jika mumpuni syarat tertentu (objektif dan subjektif). Diharapkan pemerintah desa berperan aktif dalam mengoptimalkan produk garam desa pesinggahan agar dapat memiliki hukum perlindungan yang kuat dalam bentuk hak kekayaan intelektual sebagai potensi dari indikasi geografis wilayah klungkung.

The purpose of this scientific paper is to examine the legal protection for traditional salt products in the Pesingahan Village regarding the ownership of intellectual property. The method used is in the form of empirical legal research through a statutory and factual approach. From this research, the results suggest that legal protection for traditional salt products in Pesinggahan Village is an IPR, especially the cultural heritage of Pesinggahan Village, and nationally in Indonesia it refers to Law no. 28 of 2014 concerning Copyright and Law no. 20 of 2016 concerning brands and geographical indications. Pesinggahan village salt can be used as a product of geographical indications if it fulfills certain conditions (objective and subjective). It is hoped that the village government will play an active role in optimizing salt products in the Pesinggahan Village so that they can have strong legal protection in the form of intellectual property rights as a potential geographical indication for the Klungkung region.
