TINJAUAN YURIDIS TERHADAP PERBUATAN PENIMBUNAN MASKER SAAT BENCANA NASIONAL MEWABAHNYA VIRUS CORONA

Abstract

Tulisan ini mempunyai tujuan mengetahui pengaturan perdagangan dan distribusi masker pada saat bencana nasional mewabahnya virus corona dan Untuk mengetahui sanksi hukum bagi mereka yang melakukan perbuatan penimbunan masker pada saat bencana nasioanal mewabahnya virus corona. Metode Penulisan yang dipergunakan yaitu metode penelitian normatif meneliti tentang diskriftif masalah, pendekatan penelitian ialah pendekatan undang-undang serta konseptual, sedangkan Sumber Data yang dipergunakan yaitu Sumber data Skunder yang mengacu ke UU No. 7 Tahun 2014 mengenai Perdagangan dan UU No. 5 Tahun 1999 mengenai Larangan Praktik Monopoli serta Persaingan Usaha Tak Sehat. Pengaturan hukum atas penimbun masker diuraikan di UU No.  7 tahun 2014 juga UU No. 5 tahun 1999 perihal praktik monopoli, aturan itu mampu dijadikan paying hukum guna menghukum penimbun masker. Sanksi hukum yang dapat dikenakan bagi para penimbun masker pada saat mewabahnya virus corona adalah ketentuan UU No 7 tahun 2014 juga UU No. 5 tahun 1999.

This writing has the aim of knowing the regulation of trade and distribution of masks at the time of the national disaster outbreak of the corona virus and to figure out legal sanction for those who commit the act of hoarding masks during national disaster of the corona virus outbreak. The writing method used is normative research method which examines descriptive problems, the research approach is conceptual and legal approach, while data source used are secondary data sources referring to Law no. 7 of 2014 regarding Trade and Law no. 5 of 1999 about Prohibition of Monopolistic Practices and Unfair Business Competition. Legal arrangements for hoarding masks are outlined in Law no. 7 of 2014 and Law no. 5 of 1999about monopolistic practices, this regulation can be used as a legal umbrella to punish mask hoarders. The legal sanctions that can be imposed on mask hoarders during the outbreak of the corona virus are the provisions of Law Number 7 of 2014 also Law Number 5 of 1999.
