PENGATURAN DUE PROCESS OF LAW DALAM SISTEM PERADILAN PIDANA INDONESIA GUNA MEMENUHI HAK ASASI MANUSIA

Abstract

Penelitian ini ditujukan untuk melihat bagaimanakah pengaturan Due Process of Law pada sistem peradilan pidana di Indonesia dalam rangka memenuhi hak asasi manusia (HAM). Metode yang dipakai di sini yaitu metode penelitian hukum yuridis normatif melalui pendekatan perundang-undangan. Hasil penelitian menunjukan bahwasannya adanya Due Process of Law dalam sistem peradilan pidana dapat menciptakan sistem peradilan pidana yang terpadu, hal tersebut mengartikan bahwa peran dari Due Process of Law sangatlah penting. Selain itu, dalam sistem peradilan pidana di Indonesia terbukti telah cukup memenuhi perlindungan HAM hal tersebut terlihat pada pengaturan yang termuat dalam UU Hukum Acara Pidana, yaitu pada pengakuan persamaan di hadapan hukum, penerapan asas praduga tak, pemenuhan berbagai hak tersangka, serta tercantumnya beberapa asas dalam hukum acara pidana.

The purpose of this research is to find out how the regulate of the Due Process of Law in the criminal justice system in Indonesia in order to fulfill human rights. The method used here is a normative juridical legal research method with a statute approach. The results of this reasearch indicate that the Due Process of Law in the criminal justice system able to create an integrated criminal justice system, this means that the role of the Due Process of Law is very important. In addition, the criminal justice system in Indonesia has been proven to have adequately fulfilled human rights protections, this is evidenced in the arrangements contained in the Criminal Procedure Code, namely the recognition of equality before the law, the application of the principle of presumption of innocence, the fulfillment of various rights of suspects, and the inclusion of several principles in the criminal procedure law.
