PENERAPAN ASAS KESEIMBANGAN DALAM PERJANJIAN JASA TITIP ONLINE MELALUI APLIKASI INSTAGRAM

Abstract

Penelitian ini bertujuan untuk mengetahui penerapan asas keseimbangan dalam perjanjian layanan jasa titip online, dan bagaimana menyelesaikan perselisihan jika pembeli melanggar aturan dalam perjanjian layanan jasa titip online. Metode yang digunakan dalam penulisan artikel ini adalah metode normatif serta pendekatan perundang–undangan. Hasil dari penelitian ini yakni penerapan prinsip keseimbangan dalam layanan titip online dirasa sangat penting, karena prinsipnya membutuhkan perjanjian para pihak sehingga asas keseimbangan akan meminimalkan terjadinya pelanggaran dan penipuan dalam perjanjian jual beli online. Adapun apabila terjadi pelanggaran terhadap kesepakatan yang dialami oleh pelanggan maupun penyedia jasa dapat diselesaikan melalui jalur litigasi (pengadilan) maupun melalui jalur non litigasi sesuai dengan UUPK Pasal 45 ayat (2).

This study aims to determine the implementation of the principle of balance in the online deposit service agreement, and how to resolve disputes if the buyer violates the rules in the online deposit service agreement. The method used in writing this article is the normative method and the statutory approach. The results of this study, namely the application of the principle of balance in online deposit services is considered very important, because the principle requires an agreement of the parties so that the principle of balance will minimize the occurrence of violations and fraud in online buying and selling agreements. Meanwhile, if there is a violation of the agreement experienced by the customer or service provider, it can be resolved through litigation (court) or through non-litigation channels in accordance with Article 45 paragraph (2) of the UUPK.
