PERLINDUNGAN HUKUM BAGI PEMEGANG HAK CIPTA SINEMATOGRAFI TERHADAP PEMBAJAKAN FILM DI APLIKASI TIKTOK

Abstract

Penelitian ini bertujuan untuk 2 hal sebagai berikut: (1) mengetahui dan menganalisis tentang perlindungan hukum bagi pemegang hak cipta sinematografi di Indonesia dari pembajakan menurut Undang-Undang Nomor 28 Tahun 2014; dan (2) untuk mengetahui dan menganalisis tentang akibat hukum yang ditimbulkan terhadap pelanggran hak cipta sinematografi terkait pembajakan film pada aplikasi tiktok. Penelitian ini tergolong penelitian normatif yang menggunakan2 jenis pendekatan, yakni pendekatan undang-undang dan pendekatan konseptual. Berdasartkan hasil penelitian, diketahui bahwa ini perlindungan pemegang hak cipta terhadap pembajakan film sebagai suatu karya sinematografi diatur pada UU Nomor 28 Tahun 2014 dan  akibat hukumnya telah dimuat pada pasal 113 ayat (3) dan (4), dimana pelaku pembajakan dapat dikenakan pidana penjara hingga 10 tahun seta ataupun denda hingga 4 miliar rupiah. Kemudian pihak tiktok juga telah mengatur terkait hal ini pada ketentuan layanan yang bisa diakses pada website resminya, dimana pihak tiktok secara tegas menyatakan bahwa pihaknya dapat memblokir pengguna yang melanggar hak cipta ketika ada laporan dari pengguna lain yang diajukan melalui fitur report.

ABSTRACT

The puposes of this research are as follows: (1) to find out and analyze the legal protection for cinematographic copyright holders in Indonesia from piracy according to Undang-Undang Nomor 28 Tahun 2014; and (2) to find out and analyze the legal consequences for cinematographic copyright violators related to film piracy on the tiktok application. This research is classified as normative research that uses 2 types of approaches, namely the legal approach and the conceptual approach. Based on the results of the research, it is known that the protection of copyright holders against film piracy as a cinematographic work is regulated in Undang-Undang Nomor 28 Tahun 2014 and the legal consequences have been contained in Article 113 paragraphs (3) and (4), where the perpetrators of piracy can be subject to imprisonment up to 10 years or a fine of up to 4 billion rupiah. Then the tiktok party has also regulated this in the terms of service that can be accessed on the official website, where the tiktok party expressly states that it can block users who violate copyright when there are reports from other users submitted through the report feature.
