PENERAPAN DIVERSI KEPADA ANAK YANG BERKONFLIK PADA HUKUM DIWILAYAH HUKUM POLRESTA DENPASAR

Abstract

Tujuan studi ini untuk memperlajari penerapan diversi kepada anak yang berkonflik dengan hukum terkait perlindungan anak. Studi ini mengunakan penelitian empiris yaitu suatu penelitian dengan adanya data-data dilapangan sebagai sumber data utama melalui wawancara dan observasi. Hasil penelitian menunjukkan bahwa penerapan diversi di wilayah hukum polresta denpasar telah sesuai dengan yang diamanatkan oleh Undang-undang no.11 tahun 2012 tentang Sistem Peradilan Pidana Anak. Dalam perspektif perlindungan anak, salah satu pemenuhannya melalui mediasi panel yang dilakukan oleh penyidik Polresta Denpasar terhadap anak yang berkonflik dengan Hukum.

The purpose of this study is to examine the legal certainty for the blind with disabilities, visually impaired relating to the protection of access to the audiobook. This study uses a normative legal method with a statute approach and comparative approach. The study shows that legal certainty for the blind disable to gain audiobook access as one of the learning media in the digital era has been regulated internationally through the Marrakesh Treaty 2013, and nationally in Indonesia refers to Article 44 Paragraph (2) of Law Number 28 Year 2014 Concerning  Copyright and Government Regulation Number 27 Year 2019. In the perspective of human rights, obtaining information and education is a right for persons with disabilities, one of the fulfillment access through the supporting facilities of audiobook.
