TANGGUNG JAWAB PELAKU USAHA TERHADAP PENGGUNA JALAN YANG DIRUGIKAN AKIBAT KEGIATAN PROMOSI DI JALAN RAYA

Abstract

Ada 2 tujuan yang ingin dicapai dalam penelitian ini, yaitu: (1) untuk mengetahui dan menganalisis pengaturan hukum bagi pelaku usaha terkait kegiatan promosi yang merugikan pengguna jalan; (2) untuk mengetahui dan menganalisis tanggung jawab pelaku usaha terkait pengguna jalan yang dirugikan akibat kegiatan promosi di jalan raya. Metode penelitian dalam penulisan ini menggunakan jenis metode penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan konseptual. Adapun hasil dari penelitian ini, antara lain: (1) Pengaturan hukum bagi pelaku usaha terkait terkait larangan dalam kegiatan promosi di jalan raya yang menimbulkan dampak negatif bagi para pengguna jalan merujuk pada ketentuan Pasal 79 ayat 1 Undang-Undang No. 40 Tahun 2007 tentang Perseroan Terbatas, Pasal 19 huruf g Undang-Undang 25 Tahun 2007 tentang Penanaman Modal, dan Pasal 7 PP  No. 47 Tahun 2012 Tentang Tanggung Jawab Sosial dan Lingkungan Peseroan Terbatas serta Pasal 30 Perda Kota Denpasar No. 1 Tahun 2015 tentang Ketertiban Umum; (2) Tanggung jawab pelaku usaha dalam hal merugikan pengguna jalan terkait kegiatan promosi di jalan raya merupakan tanggung jawab sosial perusahaan dan administratif dikenakan sanksi apabila pelaku usaha terbukti tidak melakukan jawab tanggung sosial perusahaan yang tercantum dalam ketentuan Pasal 34 ayat 3 UUPM.

Abstract


The development of the Indonesian state led to developments in the business world. The number of new inventions has created business competition in the world of commerce. Various methods are used by business actors to promote their businesses, one of which is by promoting on the road in the form of distributing brochures, but these promotional activities often harm road users. The purposed of thisy writingh ish to know and understand the legal arrangements for business actors related to promotional activities which are detrimental to road users and to recognize the responsibilities of business actors related to road users who are disadvantaged due to promotional activities on the highway. The research method in this paper uses the normative legaly researchk methodk withn the legislation approachy and conceptually approach. The results of this paper explain that the legal arrangements for business actors related to the prohibition in promotion activities on the highway that have a negative impact on road users are regulated in the provisions of Article 74 Paragraph 1 of Company Law, Article 15 letter b of Company Law, and Article 7 PP No. 47 of 2012 and Article 30 of the Denpasar City Regulation No. 1 of 2015 concerning Public Order and the Responsibilities of Business Actors in terms of detrimental to road users related to promotional activities on the highway are corporate social responsibility and will be subjected to administrative sanctions if the business actor is proven to noty carryh outi corporatek socialo responsibility stated in the provisions of Article 34 Paragraph 3 UUPM.
