PERLINDUNGAN HUKUM TERHADAP KONSUMEN ATAS PEMBELIAN HANDPHONE IPHONE BLACK MARKET MELALUI E-COMMERCE

Abstract

Artikel ini bertujuan untuk mengeksplorasi dan menganalisis aspek perlindungan hukum bagi konsumen yang membeli iPhone black market melalui platform e-commerce. Penelitian ini mengaplikasikan pendekatan hukum normatif dengan fokus pada peraturan perundang-undangan yang relevan. Dalam penelitian ini, undang-undang berperan sebagai sumber hukum utama, sementara pasal-pasal dan literatur hukum digunakan sebagai bahan pendukung untuk mendalami topik ini secara mendalam. Penelitian ini mengidentifikasi empat fase dalam proses perjanjian jual beli iPhone black market di e-commerce dan menilai perlindungan hukum yang tersedia bagi konsumen dalam konteks ini, berdasarkan Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen. Selain itu, artikel ini menyoroti pentingnya peningkatan pengetahuan konsumen mengenai risiko dan hak mereka dalam transaksi online serta perlunya pengawasan yang lebih ketat untuk menangani peredaran barang black market secara efektif.

This article aims to explore and analyze legal protection for consumers purchasing black market iPhones through e-commerce platforms. The study employs a normative legal research approach with a focus on relevant legislative regulations. In this research, laws serve as the primary legal source, while legal articles and related literature are used as secondary materials for an in-depth examination of the subject. The study identifies four stages in the process of buying black market iPhones via e-commerce and evaluates the available legal protections for consumers within this context, based on Law No. 8 of 1999 concerning Consumer Protection. Additionally, the article highlights the importance of increasing consumer awareness about risks and their rights in online transactions, as well as the need for stricter oversight to effectively address the circulation of black market goods.
