PELAKSANAAN PRINSIP-PRINSIP DEMOKRASI PANCASILA PADA PEMERINTAHAN OTORITA IBU KOTA NUSATARA

Abstract

Penulisan jurnal ilmiah ini bertujuan untuk mengetahui, menganalisis dan meninjau secara konprehensif ketentuan kewenangan Otorita Ibu Kota Nusantara (IKN) sebagaimana diatur dalam Undang-Undang Nomor 3 Tahun 2022 tentang Ibu Kota Nusantara (UU IKN), serta mengkaji pelaksanaan prinsip-prinsip Demokrasi Pancasila dalam Pemerintahan Otirita Ibu Kota Nusantara. Adapun hasil dari jurnal ilmiah ini adalah dapat diketahui bahwa kewenanangan Otorita IKN yang memimpin daerah khusus ibu kota telah diatur secara yuridis dalam UU IKN. Otorita IKN memiliki karakter khusus yang wewenang dan kedukannya berbeda dari bentuk kepala pemerintahan daerah lainnya di Indonesia. Pelaksanaan pemerintahann daerah khusus ibu kota yang dilaksanakan oleh Otorita IKN berdasar pada prinsip teknokrasi dan modern city yang berbeda dari pelaksanaan pemerintahan daerah pada umumnya di Indoensia. Pelaksanaan pemerintahan IKN dengan menggunakan prinsip ini menimbulkan kekhawatiran diabaikannya nilai-nilai Demokrasi Pancasila. Hal ini terjadi sebab timbul beberapa permasalahan seperti pembatasan hak-hak politik Masyarakat, proses pengisian jabatan Otorita IKN yang tidak menggunakan cara demokratis serta hilangnya unsur lembaga pewakilan daerah (DPRD). Oleh karena itu, sudah seharusnya pemerintah Indonesia melakukan desain ulang terkait konsep pelaksanaan pemerintah IKN yang tercantum dalam UU IKN sehingga nilai-nilai Demokrasi Pancasila yang menjadi pedoman pelaksanaan pemerintahan negara tidak dikurangi atau diabaikan.

The aim of writing this scientific journal is to understand, analyze and comprehensively review the provisions of the authority of the Nusantara Capital Authority (IKN) as regulated in Law Number 3 of 2022 concerning Archipelago Capital (UU IKN), as well as examine the implementation of the principles of Pancasila Democracy in Government of Otirita, Capital of the Archipelago. The results of this scientific journal show that the authority of the IKN Authority which leads the special capital region has been regulated juridically in the IKN Law. The IKN Authority has a special character whose authority and position are different from other forms of regional government heads in Indonesia. The implementation of regional government specifically for the capital city carried out by the IKN Authority is based on the principles of technocracy and modern city which are different from the implementation of regional government in general in Indonesia. The implementation of the IKN government using this principle raises concerns that the democratic values of Pancasila are being ignored. This happened because several problems arose, such as restrictions on people's political rights, the process of filling IKN Authority positions not using democratic methods and the loss of elements of regional representative institutions (DPRD). Therefore, the Indonesian government should carry out a redesign regarding the concept of implementing the IKN government as stated in the IKN Law so that the values of Pancasila Democracy which guide the implementation of state government are not reduced or ignored.
