ANALISIS NORMATIF PERLINDUNGAN HUKUM BAGI KURIR TERKAIT KETIDAKSESUAIAN BARANG DALAM TRANSAKSI CASH ON DELIVERY

Abstract

Studi ini bertujuan “untuk mengetahui pengaturan hukum pembelian barang melalui cash on delivery (COD) dan untuk mengetahui perlindungan hukum bagi kurir apabila terjadi ketidaksesuaian barang dalam transaksi cash on delivery (COD); Studi ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan serta pendekatan analisis; Hasil studi ini menunjukkan bahwa pengaturan hukum pembelian barang melalui sistem cash on delivery (COD) terdapat dalam Kitab Undang-Undang Hukum Perdata dan juga diatur dalam Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen, dalam transaksi cash on delivery (COD) belanja online seringkali kurir terkena imbas terkait ketidaksesuaian barang yang diterima pembeli dalam belanja online, oleh karena itu maka perlu adanya perlindungan hukum terhadap kurir, perlindungan hukum yang dapat diberikan kepada kurir dalam transaksi cash on delivery (COD) yaitu dengan menjamin bahwa ketidaksesuaian barang yang diterima oleh pembeli bukan merupakan tanggung jawab kurir dan kurir tidak bertanggung jawab terhadap hal tersebut kecuali ketidaksesuaian atau kerusakan barang disebabkan oleh kelalaian dari kurir itu sendiri sebagaimana yang diatur dalam Pasal 1708 Kitab Undang-Undang Hukum Perdata. terkait dengan ketidaksesuaian barang yang diterima pembeli merupakan tanggung jawab dari penjual tempat pembeli membeli barang tersebut.”

This study “aims to determine the legal regulations for purchasing goods via cash on delivery (COD) and to determine the legal protection for couriers if there is a mismatch between goods in a cash on delivery (COD) transaction;  This study uses normative legal research methods with a statutory approach and an analytical approach;  The results of this study show that the legal regulations for purchasing goods through the cash on delivery (COD) system are contained in the Civil Code and are also regulated in Law Number 8 of 1999 concerning Consumer Protection,  In cash on delivery (COD) transactions for online shopping, couriers are often affected by the incompatibility of goods received by buyers during online shopping,  Therefore, there is a need for legal protection for couriers,  legal protection that can be given to couriers in cash on delivery (COD) transactions is by guaranteeing that the non-conformity of goods received by the buyer is not the responsibility of the courier and the courier is not responsible for this unless the non-conformity or damage to the goods is caused by the courier's own negligence  as regulated in Article 1708 of the Civil Code,  related to non-conformity of goods received by the buyer is the responsibility of the seller where the buyer purchased the goods.”
