PERLINDUNGAN HAK CIPTA ATAS PENGGUNAAN LAGU SEBAGAI BACKSOUND DI LIVE STREAMING GAME DI FACEBOOK

Abstract

Tujuan penulisan jurnal ilmiah ini untuk mengetahui perlindungan hak cipta musik di dalam UU Nomor 28 Tahun 2014 tentang Hak Cipta terkait dengan penggunaan lagu sebagai backsound dalam siaran langsung Facebook. Metode yang digunakan dalam penulisan jurnal ilmiah ini adalah metode penelitian hukum normatif dengan pendekatan yuridis. Dalam penelitian ini ditemukan bahwa perlindungan hak cipta, khususnya musik yang digunakan menjadi backsound siaran langsung Facebook, diatur pada Pasal 5 dan pasal 9 UU Hak Cipta. Upaya hukum yang dapat ditempuh oleh pencipta apabila terjadi pelanggaran terhadap suatu karya ciptanya adalah melalui upaya preventif dan upaya represif. Penyelesaian sengketa Hak Cipta sebagaimana yang diamanatkan oleh Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta. Pasal 95 ayat 1 disebutkan bahwa Penyelesaian sengketa Hak Cipta dapat dilakukan melalui alternatif penyelesaian sengketa, arbitrase, atau pengadilan. Pengadilan perdata yang berwenang dalam arti memiliki kompetensi mutlak dalam perkara ini adalah Pengadilan Niaga. Kata Kunci : Backsound, Hak Cipta, Facebook ABSTRACT The purpose of writing this scientific journal is to find out the protection of music copyright in Law Number 28 of 2014 concerning Copyrights related to the use of songs as backsound in Facebook live broadcasts. The method used in writing this scientific journal is a normative legal research method with a juridical approach. In this study, it was found that copyright protection, especially music used as the backsound for Facebook live broadcasts, is regulated in Article 5 and Article 9 of the Copyright Law. Legal remedies that can be taken by the creator in the event of a violation of his copyrighted work are through preventive and repressive efforts. Settlement of Copyright disputes as mandated by Law Number 28 of 2014 concerning Copyright. Article 95 paragraph 1 states that Copyright dispute settlement can be done through alternative settlement, arbitration, or court.
