PERLINDUNGAN HUKUM HAK MILIK ATAS TANAH DALAM PERKAWINAN CAMPURAN DI INDONESIA: STUDI KASUS PENYELESAIAN SENGKETA MELALUI JUDICIAL REVIEW

Abstract

Penelitian ini ditujukan untuk mengkaji perlindungan hukum hak milik atas tanah bagi WNI dalam perkawinan campuran serta mengevaluasi mekanisme judicial review dalam menyelesaikan sengketa hak milik atas tanah. Metode yang dipergunakan yakni penelitian hukum normatif melalui pendekatan perundang-undangan serta analisis konseptual terhadap regulasi yang berlaku dan dampak judicial review terhadap kebijakan agraria. Hasil penelitian menunjukkan bahwa judicial review berperan penting dalam memperjuangkan hak konstitusional individu, terutama melalui Putusan Mahkamah Konstitusi yang memungkinkan perjanjian pranikah dibuat setelah perkawinan berlangsung. Putusan ini memberikan kepastian hukum bagi WNI dalam perkawinan campuran dan mendorong reformasi hukum agraria yang lebih inklusif.

ABSTRACT

This study aims to examine the legal protection of land ownership for Indonesian citizens in mixed marriages and to evaluate the judicial review mechanism in resolving land ownership disputes. The method used is normative legal research with a statutory approach and conseptual analysis of applicable regulations and the impact of judicial review on agrarian policies. The results of the study indicate that judicial review plays an important role in fighting for individual constitutional rights, especially through the Constitutional Court Decision which allows prenuptial agreements to be made after the marriage has taken place. This decision provides legal certainty for Indonesian citizens in mixed marriages and encourages more inclusive agrarian law reform.
