PERLINDUNGAN HUKUM TERHADAP STREAMER ATAS KERUGIAN YANG DITIMBULKAN AKIBAT PROMOSI JUDI ONLINE PADA PLATFORM STREAMING

Abstract

Tujuan dilakukannya riset ini adalah untuk menelisik ketidakpastian upaya perlindungan hukum terhadap streamer sebagai pelaku usaha di bidang seni (content creator), terhadap tindakan oknum judi online yang tidak beritikad baik di dalamnya dengan mempromosikan situs perjudian online. Dalam riset in menggunakan metode penelitian normatif dengan pendekatan perundang-undangan (the statute approach) dan pendekatan kasus (case approach). Hasil riset ini menunjukan di dalam upaya perlindungan hukum kepada streamer didalam Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen  tergolong kabur yang dimana pada Pasal 6 huruf b undang-undang tersebut terkhusus pada frasa “perlindungan hukum” yang diperkuat dengan tidak adanya penjelasan signifikan maupun aturan lebih lanjut mengenai perlindungan hukum yang seyogyanya diberikan kepada streamer selaku pelaku usaha serta dalam UUPK hanya berfokus kepada konsumen sehingga posisi Streamer dalam hal ini tergolong lemah, Dengan demikian dapat diberlakukan asas “Lex specialis derogate legi generalis” didalam pertanggungjawaban yang dilimpahkan kepada oknum judi online atas kerugian yang dialami streamer.

ABSTRACT

The purpose of this research is to examine the uncertainty of legal protection efforts for streamers as business actors in the arts (content creators), against the actions of online gambling individuals who do not have good intentions in promoting online gambling sites.  This research uses normative research methods with a statutory approach and a case approach.  The results of this research show that legal protection efforts for streamers in Law Number 8 of 1999 concerning Consumer Protection are relatively vague, where in Article 6 letter b of the law, specifically the phrase "legal protection" is strengthened by the absence of significant explanations or regulations.  further regarding the legal protection that should be given to streamers as business actors and in the UUPK it only focuses on consumers so that the position of streamers in this case is relatively weak. Thus, the principle of "Lex specialis derogate legi generalis" can be applied in the responsibility delegated to online gambling individuals for losses experienced by streamers.
