PENGATURAN SANKSI DENDA ADMINISTRATIF TERHADAP PELANGGARAN PENANGGULANGAN COVID-19
Abstract
Penelitian ini bertujuan untuk memahami dasar mekanisme pembentukan sanksi administratif pasca Undang-Undang No. 12 Tahun 2011 tentang Tata Pembentukan Peraturan Perundang-Undangan dan menganalisis Pengaturan kewenangan pemerintah daerah dalam mengeluarkan kebijakan pengaturan sanksi denda administratif terhadap pelaku pelanggaran kebijakan penanggulangan COVID-19 yang diterapkan di wilayah Provinsi Bali ditinjau dari prespektif Hukum Tata Negara Penelitian ini menggunakan metode penelitian yuridis normatif, data yang digunakan dalam penelitian ini adalah data sekunder yang diperoleh dari studi kepustakaan. Berdasarkan hasil penelitian disimpulkan bahwa Kaidah perumusan sanksi administratif tidak boleh bertentangan peraturan perundang-undangan yang lebih tinggi atau sebagai delegasi peraturan pelaksana dari peraturan yang lebih tinggi serta memenuhi Teknik Penyusunan Pembentukan Peraturan Perundang-Undangan menurut Lampiran II UU No. 12 tahun 2011 tentang Pembentukan Peraturan Perundang-Undangan. Kemudian daripada itu, Pengaturan Sanksi Denda Administratif Terhadap Pelaku Pelanggaran Kebijakan Penanggulangan COVID-19 di Provinsi Bali diatur melalui berbagai Peraturan Peraturan Perundang-Undangan terkait Penanggulangan COVID-19 dan Kebijakan Pemerintah Pusat yang diturunkan dalam Peraturan Daerah Provinsi Bali serta diatur lebih lanjut oleh Peraturan Gubernur, Instruksi Gubernur, dan dimuat Peraturan Daerah Kabupaten / Kota hingga didorong pelaksanaannya dengan Peraturan Desa melalui tindakan pengawasan kedisiplinan kepatuhan masyarakat oleh Satgas COVID-19 yaitu Satpol PP dan Pecalang yang ditunjuk dalam memberikan sanksi denda administratif kepada pelaku pelanggaran kebijakan COVID-19 di Bali. Pemberian sanksi denda administratif ini juga harus selaras dengan ketahanan masyarakat dengan memperhatikan rasa kemanusiaan mengingat dampak kesehatan masyarakat dan lumpuhnya perekonomian dalam situasi berkepanjangan akibat pandemi COVID-19.
This study aims to understand the basic mechanism for the formation of administrative sanctions after Law no. 12 of 2011 concerning the Procedure for the Establishment of Legislation and analyzing the normative basis regarding the authority of the Bali Provincial government in issuing policies for setting administrative fines for perpetrators of violations of the COVID-19 response policy implemented in the Province of Bali in terms of the perspective of the Constitutional Law. using normative juridical research methods, the data used in this study is secondary data obtained from library research. Based on the results of the study, it was concluded that the rules for formulating administrative sanctions should not conflict with higher laws and regulations or as delegates for implementing regulations from higher regulations and meet the Techniques for Formulating the Formation of Legislations according to Attachment II of Law no. 12 of 2011 concerning the Establishment of Legislation. Then from that, the Regulation of Administrative Fines Against Perpetrators of Violation of the COVID-19 Response Policy in the Province of Bali is regulated through various Laws and Regulations related to COVID-19 Management and Central Government Policies which are revealed in the Bali Provincial Regulations and further regulated by Regulations. Governor, Governor's Instructions, and loaded with Regency / City Regulations so that their implementation is encouraged by Village Regulations through the action of monitoring community compliance discipline by the COVID-19 Task Force, namely Satpol PP and Pecalang who are appointed to provide administrative fines to perpetrators of COVID-19 policy violations in Bali . The imposition of administrative fines must also be in line with community resilience by paying attention to the sense of humanity given the impact of public health and the paralysis of the economy in a prolonged situation due to the COVID-19 pandemic.
