CEGAH HOAKS SARA DALAM PILKADA: BAGAIMANA PERAN BAWASLU DAN PENGATURAN ELEKTRONIK?

Abstract

Tujuan dari penulisan ini untuk mengidentifikasi efektifitas implementasi dari pasal 28 ayat (2) dan ayat (3) UU no 1 tahun 2024 tentang Informasi dan Transaksi Elektronik sebagai penanganan berita hoaks dan isu sara pada pemilihan kepala daerah serta menganalisis peran BAWASLU dalam penanganan berita hoaks dan isu sara pada pemilihan kepala daerah provinsi maluku utara 2024. Jenis penelitian yang digunakan ialah penelitian normatif-empiris, yang akan dilakukan penulis yaitu menggali informasi dilapangan (Field Research). Penelitian normatif-empiris digunakan untuk menganalisis atau mengetahui sudah sejauh mana peraturan atau undang-undang dan hukum yang berjalan secara efektif. Kehadiran undang-undang terkait menggunakan pengaturan cybercrime ini tentu saja sangat diharapkan pada penegakan aturan pidana, terutama kejahatan-kejahatan yang memang lahir dari kehadiran teknologi tadi, terdapat Beberapa kasus yang memperlihatkan bahwa (PILKADA) pada provinsi maluku utara terdapat indikasi pelanggaran penyebaran isu tidak sahih (HOAX) dan pengguna isu SARA (suku, agama, rasa serta antargolongan) berpotensi memecah rakyat, (Bawaslu) merupakan forum independen yang bertugas buat mengawasi dan menegakkan keadilan pada penyelenggaraan pemilu di Indonesia pengawasan Pemilu Bawaslu bertanggung jawab melakukan supervisi terhadap semua tahapan awal hingga akhir hingga Penyelidikan Pelanggaran.

The purpose of this paper is to identify the effectiveness of the implementation of Article 28 paragraph (2) and paragraph (3) of Law No. 1 of 2024 concerning Electronic Information and Transactions as a handling of hoax news and sara issues in regional head elections and analyze the role of BAWASLU in handling hoax news and sara issues in the 2024 North Maluku provincial head election. The type of research used is normative-empirical research, which the author will do by digging up information in the field (Field Research). Normative-empirical research is used to analyze or find out the extent to which regulations or laws and laws are running effectively. The presence of related laws using cybercrime arrangements is of course very much expected in the enforcement of criminal rules, especially crimes that were born from the presence of technology earlier, there are several cases that show that (PILKADA) in the province of North Maluku there are indications of violations of the spread of invalid issues (HOAX) and the use of SARA (ethnicity, religion, taste and intergroup) issues that have the potential to divide the people, (Bawaslu) is an independent forum in charge of overseeing and upholding justice in the implementation of elections in Indonesia Bawaslu Election Supervision is responsible for supervising all stages from the beginning to the end to the Investigation of Violations.
