IMPLEMENTASI ASAS PACTA SUNT SERVANDA PADA PERJANJIAN JUAL-BELI SECARA LISAN PADA KENDARAAN BERMOTOR
Abstract
Penelitian ini membahas implementasi asas pacta sunt servanda dalam perjanjian jual beli lisan yang dilakukan di Showroom Mandiri Motor. Asas pacta sunt servanda menyatakan bahwa setiap perjanjian yang dibuat secara sah berlaku sebagai undang-undang bagi para pihak yang membuatnya. Meskipun hukum perdata Indonesia mengakui perjanjian lisan sebagai sah sepanjang memenuhi syarat sahnya perjanjian, pelaksanaan dan penegakan hak-hak para pihak dalam praktik sering menimbulkan permasalahan, terutama jika tidak disertai bukti tertulis. Penelitian ini menggunakan pendekatan yuridis empiris, dengan data primer diperoleh melalui wawancara dan observasi langsung, serta data sekunder dari studi pustaka. Hasil penelitian menunjukkan bahwa perjanjian jual beli lisan di Showroom Mandiri Motor umumnya dilakukan berdasarkan asas kepercayaan dan kebiasaan, namun dalam beberapa kasus timbul sengketa akibat perbedaan persepsi atau wanprestasi. Meskipun demikian, asas pacta sunt servanda tetap dijadikan landasan dalam menyelesaikan sengketa, baik secara kekeluargaan maupun melalui jalur hukum. Penelitian ini menyimpulkan bahwa perlindungan hukum terhadap perjanjian lisan masih lemah, sehingga disarankan agar setiap transaksi penting dituangkan secara tertulis untuk memberikan kepastian hukum bagi para pihak.
This research discusses the implementation of the principle of pacta sunt servanda in oral sales agreements conducted at Showroom Mandiri Motor. The principle of pacta sunt servanda states that every agreement made legally is binding as law for the parties who make it. Although Indonesian civil law recognizes oral agreements as valid as long as they meet the legal requirements for agreements, the implementation and enforcement of the parties' rights in practice often pose problems, especially if not accompanied by written evidence. This research uses an empirical juridical approach, with primary data obtained through interviews and direct observation, as well as secondary data from literature studies. The research results show that oral sales agreements at Mandiri Motor Showroom are generally made based on the principles of trust and habit, but in some cases, disputes arise due to differences in perception or breach of contract. Nevertheless, the principle of pacta sunt servanda remains the foundation for resolving disputes, whether through familial means or legal channels. This research concludes that legal protection for oral agreements is still weak, therefore it is recommended that every important transaction be documented in writing to provide legal certainty for the parties involved.
