PERLINDUNGAN BAGI INVESTOR DALAM INVESTASI ASET KRIPTO BERBASIS APLIKASI EDCCASH: BENTUK BADAN PENGAWAS PERDAGANGAN BERJANGKA KOMODITI

Abstract

Perkembangan teknologi digital telah mendorong munculnya aset kripto sebagai instrumen investasi modern yang diperdagangkan secara luas. Di Indonesia, aset kripto dikategorikan sebagai komoditas berjangka dan diawasi oleh Bappebti, meskipun belum diakui sebagai alat pembayaran yang sah. Penelitian ini mengkaji efektivitas pengawasan Bappebti dalam melindungi investor, khususnya melalui studi kasus aplikasi EDCCash yang beroperasi tanpa legalitas dan merugikan masyarakat. Hasil analisis menunjukkan bahwa Bappebti telah menerapkan pengawasan melalui pendekatan preventif dan represif, namun masih terdapat celah hukum terkait transparansi informasi, keamanan data pribadi, dan lemahnya penegakan terhadap aset ilegal. Oleh karena itu, diperlukan penguatan regulasi, pembaruan kebijakan, serta sinergi antara Bappebti, OJK, dan Bank Indonesia untuk menjamin perlindungan hukum yang adaptif dan menyeluruh bagi investor aset kripto di era digital.

The development of digital technology has encouraged the emergence of crypto assets as a modern investment instrument that is widely traded. In Indonesia, crypto assets are categorized as futures commodities and are supervised by Bappebti, although they have not been recognized as legal tender. This study examines the effectiveness of Bappebti's supervision in protecting investors, especially through a case study of the EDCCash application which operates without legality and is detrimental to the community. The results of the analysis show that Bappebti has implemented supervision through a preventive and repressive approach, but there are still legal loopholes related to information transparency, personal data security, and weak enforcement of illegal assets. Therefore, it is necessary to strengthen regulations, update policies, and synergy between Bappebti, OJK, and Bank Indonesia to ensure adaptive and comprehensive legal protection for crypto asset investors in the digital era.
