PERLINDUNGAN HUKUM BERUPA PENGEMBALIAN ASET BAGI KORBAN INVESTASI TRADING FOREX DI INDONESIA

Abstract

Tujuan studi ini untuk mengidentfikasi bentuk pengembalian aset hasil tindak pidana di Indonesia dan menganalisis kendala Penuntut Umum dalam pengembalian aset korban Trading Forex di Indonesia. Studi ini menggunakan metode penelitian yuridis normative dengan pendekatan statue approach, conceptual approach, dan case approach. Hasil studi menunjukkan bahwa bentuk pengembalian aset hasil tindak pidana di Indonesia dibagi menjadi 2 (dua) mekanisme yaitu mekanisme in personam (secara pidana) dan mekanisme in rem (secara perdata). Dalam pengembalian aset Penuntut Umum memiliki beberapa kendala, yaitu korban tidak mau didengar keterangannya, tidak berkenan menjadi anggota paguyuban, korban berinvestasi dengan uang tunai/cash, korbannya mencapai angka cukup besar, pelaku sudah mengubah bentuk atau membelanjakan uang para investor, dst.

The aim of this study is to provide an understanding of the form of return of assets resulting from criminal acts in Indonesia and to understand the obstacles faced by the Public Prosecutor in returning the assets of Forex Trading victims in Indonesia. This study uses normative juridical research methods with the statue approach, conceptual approach and case approach. The results of the study show that the form of return of assets resulting from criminal acts in Indonesia is divided into 2 (two) mechanisms, namely the in personam (criminal) mechanism and the in rem (civil) mechanism. In returning assets, the Public Prosecutor has several obstacles, namely the victim does not want to hear his statement, does not want to become a member of the community, the victim invested with cash, the victim reached quite a large amount, the perpetrator has changed the form or spent the investors' money, etc.
