PERLINDUNGAN SAKSI DALAM PERKARA PIDANA YANG DITANGANI OLEH KEPOLISIAN DAERAH

Abstract

Penelitian ini memiliki tujuan untuk menganalisis perlindungan saksi dalam perkara pidana yang ditangani oleh Kepolisian Daerah Nusa Tenggara Barat. Jenis penelitian ini adalah penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan konseptual. Hasil penelitian mengenai bentuk perlindungan terhadap saksi yang memberikan kesaksiannya di Kepolisian Daerah Nusa Tenggara Barat dibedakan menjadi dua yang dalam hal ini adalah saksi yang dilindungi oleh Lembaga Perlindungan Saksi Dan Korban (LPSK) dengan saksi yang tidak dilindungi oleh LPSK. Saksi yang dilindungi oleh LPSK maka bentuk perlindungannya mengacu kepada ketentuan Pasal 5 Undang-Undang Nomor 31 Tahun 2014 tentang perlindungan saksi dan korban. Sedangkan perlindungan hukum bagi saksi yang tidak dilindungi oleh LPSK mengacu kepada ketentuan Undang-Undang Nomor 8 Tahun 1981 tentang Hukum Acara Pidana.

This research aims to analyze the protection of witnesses in criminal cases handled by the West Nusa Tenggara Regional Police. This is a normative legal research with a legislative and conceptual approach. The research findings regarding the forms of protection for witnesses giving testimony at the West Nusa Tenggara Regional Police are divided into two categories, namely witnesses protected by the Witness and Victim Protection Agency (LPSK) and witnesses not protected by LPSK. Witnesses protected by LPSK are governed by the provisions of Article 5 of Law Number 31 of 2014 concerning witness and victim protection. On the other hand, the legal protection for witnesses not protected by LPSK is based on the provisions of Law Number 8 of 1981 concerning Criminal Procedure Law.
