Pola Kerjasama Pemerintah Dengan Pihak Swasta Dalam Pembangunan Infrastruktur

Abstract

ABSTRAK

Tujuan dari jurnal ini adalah untuk memahami serta menganalisa kerjasama yang terjadi antara pemerintah dengan badan usaha swasta terutama dalam menangani pembangunan infrastruktur, seperti pola kerjasama yang terjadi serta pola penyelesaian apabila terjadi wanprestasi antara para pihak dalam Public Private Partnership atau di Indonesia sering disebut dengan Kemitraan Pemerintah dan Swasta yang diatur dalam Peraturan Presiden Nomor 56 Tahun 2011 tentang Perubahan Kedua atas Peraturan Presiden Nomor 67 Tahun 2005 Tentang Kerjasama Pemerintah dengan Badan Usaha Dalam Penyediaan Infrastruktur. Bentuk penelitian dalam penulisan karya ilmiah ini adalah metode penelitian normatif dengan menganalisa ketentuan hukum berlaku, bersumber dari bahan hukum primer yakni peraturan perundang-undangan serta bahan hukum sekunder yang berasal dari buku dan penulisan karya ilmiah hukum lainnya. Hasil studi menyatakan bahwa pola kerjasama yang terjadi antara pemerintah dengan pihak swasta salah satunya adalah Build, Operate, Transfer (BOT). PPP dapat menimbulkan potesi keuntungan yang diikuti resiko kerugian seperti wanprestasi yang dapat diselesaikan melalui jalur litigasi maupun non-litigasi tergantung kesepakatan para pihak.

ABSTRACT

The purpose of this journal is to understand and analyze the cooperation that occurs between the government and private business entities, especially in handling infrastructure development, such as the pattern of cooperation that occurs and the pattern of settlement in the event of a default between the parties in the Public Private Partnership or in Indonesia it is often called the Government Partnership. and Private sector as regulated in Presidential Regulation Number 56 of 2011 concerning the Second Amendment to Presidential Regulation Number 67 of 2005 concerning Government Cooperation with Business Entities in Infrastructure Provision. The form of research in writing this scientific paper is a normative research method by analyzing applicable legal provisions, sourced from primary legal materials namely legislation and secondary legal materials derived from books and other legal scientific writings. The results of the study state that the pattern of cooperation between the government and the private sector is one of them is Build, Operate, Transfer (BOT). PPP can lead to potential profits followed by risks of losses such as default which can be resolved through litigation or non-litigation depending on the agreement of the parties.
