PENYEBARAN FILM DALAM APLIKASI TELEGRAM: PERSPEKTIF HAK CIPTA

Abstract

Tujuan dari dilakukannya pembuatan artikel ini adalah untuk mengkaji lebih dalam mengenai permasalahan pelanggaran hak cipta dengan adanya pembajakan di dalam dunia perfilman. Pembajakan ini marak terjadi melalui aplikasi media sosial. Selain itu, penelitian yang telah dilakukan memiliki suatu tujuan mengetahui perlindungan hukum yang dapat diterapkan dalam perlindungan bagi hak cipta dari suatu karya film. Proses penelitian artikel ini menerapkan tahapan dari metode penelitian normatif yang mendekatkan pada peraturan perundang-undangan. Hasil dari penelitian yang dilakukan memperlihatkan bahwa adanya kasus pelanggaran hak cipta berupa pembajakan yang terjadi melalui aplikasi telegram. Dimana kasus ini marak terjadi karena adanya kemudahan akses dalam aplikasi tersebut. Penyebaran film secara ilegal melalui telegram biasa dilakukan melalui fitur grup yang terdapat di dalam aplikasi.

The purpose of this article is to take a deeper look at the issue of copyright infringement due to piracy in the film industry. Piracy is rife through social media applications. Furthermore, the purpose of this research is to find legal protections that can be applied to protect the copyright of cinematographic works. The research process in this article uses prescriptive research methods that bring laws and regulations closer together. The results of the research conducted show that there are cases of copyright infringement in the form of piracy that occur through the Telegram application. Where this case often happened because of the ease of access in the application. Illegal distribution of movies in telegram usually done through the group feature in the application.
