PERLINDUNGAN HUKUM TERHADAP MASYARAKAT BALI ATAS LIQUEFIED PETROLEUM GAS 3 KILOGRAM MELEBIHI HARGA ECERAN TERTINGGI

Abstract

Tujuan dari ditulisnya artikel ini ialah untuk tahu akan perlindungan hukum terhadap masyarakat Bali yang memperoleh harga liquefied petroleum gas 3 kilogram diatas harga eceran tertinggi serta mengkaji upaya hukum bagi masyarakat Bali yang memperoleh harga liquefied petroleum gas 3 kilogram diatas harga eceran tertinggi. Penulisan artikel dilakukan dengan mempergunakan metode penelitian hukum normatif melalui pendekatan undang-undang dengan mempergunakan bahan hukum primer dan sekunder. Melalui penelitian ini diperoleh bahwa belum diaturnya mengenai perlindungan hukum terhadap masyarakat Bali yang memperoleh harga liquefied petroleum gas 3 kilogram melebihi harga eceran tertinggi dalam PergubBali No. 10 Tahun 2018 Tentang Perubahan Kedua Atas Pergub No. 48 Tahun 2014. Hal tersebut dikarenakan dalam Peraturan Gubernur tersebut belum diatur mengenai larangan bagi pelaku usaha yang bermaksud menambahkan segala bentuk komponen biaya lainnya di luar harga eceran tertinggi. Bentuk upaya perlindungan hukum bagi masyarakat Bali yang merasa dirugikan karena memperoleh harga LPG tabung 3 kilogram melebihi harga eceran tertinggi yaitu upaya preventif berupa UU No. 8 Tahun 1999  tentang  Perlindungan  Konsumen  dan upaya represif yang dilaksanakan melalui penyelesaian sengketa secara non litigasi maupun litigasi.

The purpose of writing this article is to find out the legal protection for Balinese people who get liquefied petroleum gas 3 kilograms with prices exceed the highest retail price and to examine legal remedies for Balinese people who get liquefied petroleum gas 3 kilograms with prices exceed the highest retail price. Article writing is carried out using normative legal research methods through a legal approach using primary and secondary legal materials. The results of this study indicate that there is no legal protection for Balinese people who get liquefied petroleum gas 3 kilograms with prices exceed the highest retail price in Bali Governor Regulation Number 10 of 2018 concerning the Second Amendment to Governor Regulation Number 48 of 2014. That because, in that Governor's Regulation has not been regulated regarding the prohibition for the seller to add all forms of other cost components other than the highest retail price. Forms of legal protection for Balinese people who find aggrieved because the price of 3 kilogram LPG exceeds the highest retail price, namely preventive measures in the form of Law Number 8 of 1999 concerning Consumer Protection and repressive efforts carried out by non-litigation and litigation dispute resolution.
