KEWENANGAN INSPEKTORAT PROVINSI BALI SEBAGAI AHLI AUDIT DALAM PERKARA TINDAK PIDANA KORUPSI PADA LEMBAGA PERKREDITAN DESA

Abstract

Tujuan studi ini untuk mengkaji memahami dan menguraikan lebih rinci terkait Kewenangan Inspektorat Provinsi Bali Sebagai Ahli Audit Dalam Tindak Pidana Korupsi Pada Lembaga Perkreditan Desa. Metode penilitian yang diterapkan guna menyusunan penelitian berbentuk jurnal ilmiah ini ialah metode penelitian yuridis normatif yang merupakan satu dari sekian model metode penelitian yang meletakan objeknya ialah norma hukum dari sebuah penelitian. Hasil studi menunjukan bahwa UndangUndang PTPK tidak menegaskan secara eksplisit siapa dan bagaimana kualifikasi ahli yang berhak untuk memeriksa kerugian keuangan negara, namun berdasarkan Pasal 10 ayat (1) UU BPK, BPK berwenang dalam menghitung dan menetapkan kerugian keuangan negara. Sementara Pasal kewenangan BPKP untuk memeriksa kerugian keuangan negara diatur dalam Pasal 3 huruf Peraturan Presiden Nomor 192 Tahun 2014 tentang Badan Pengawasan Keuangan dan Pembangunan, sedangkan KPK bersama Unit Forensik Akuntansi Direktorat Deteksi dan Analisis Korupsi yang bertugas menghitung kerugian negara dalam kasus tipikor berwenang untuk melakukan perhitungan terhadap kerugian negara Kewenangan Inspektorat Provinsi menjadi auditor dalam kasus tindak pidana korupsi pada LPD termaktub dalam SEMA Nomor 4 Tahun 2016 tentang Pemberlakuan Rumusan Hasil Rapat Pleno Kamar Mahkamah Agung Tahun 2016 Sebagai Pedoman Pelaksanaan Tugas Bagi Pengadilan, yang secara eksplisit mengatur bahwa lembaga yang berhak menghitung dan menyatakan adanya kerugian negara adalah BPK. Sementara lembaga lain seperti BPKP hanya berwenang melakukan penghitungan kerugian negara, tapi tidak berhak menyatakan adanya kerugian negara.

The aim of this study is to examine understanding and explaining in more detail the Authority of the Bali Provincial Inspectorate as an Audit Expert in Corruption Crimes in Village Credit Institutions. The research method applied to compile research in the form of a scientific journal is the normative juridical research method which is one of several researchmethod models whose object is the legal norms of research. The study results show that the PTPK Law does not explicitly state who and what the qualifications of experts are who have the right to examine state financial losses, however, based on Article 10 paragraph (1) of the BPK Law, the BPK has the authority to calculate and determine state financial losses. Meanwhile, the BPKP's authority to examine state financial losses is regulated in Article 3 letter of Presidential Regulation Number 192 of 2014 concerning the Financial and Development Supervisory Agency, while the Corruption Eradication Commission together with the Forensic Accounting Unit of the Corruption Detection and Analysis Directorate which is tasked with calculating state losses in corruption cases have the authority to carry out the calculations. against state losses. The authority of the Provincial Inspectorate to act as an auditor in cases of criminal acts of corruption in the LPD is contained in SEMA Number 4 of 2016 concerning the Implementation of the Formulation of the Results of the 2016 Supreme Court Chamber Plenary Meeting as Guidelines for the Implementation of Duties for the Court, which explicitly regulates that the institution has the right to calculate and stated that there was a loss to the state was the BPK. Meanwhile, other institutions such as BPKP only have the authority to calculate state losses, but do not have the right to declare state losses.
